The Devolution (Immigration) (Scotland) Bill is a private member’s bill, sponsored by Stephen Gethins of the Scottish National Party. Its second reading is scheduled to take place on Friday 25 April 2025.
The bill contains a single substantive clause:
1. Legislative competence for immigration
In Part 2 of Schedule 5 to the Scotland Act 1998 (specific reservations), in section B6 omit the words “immigration, including asylum and the status and capacity of persons in the United Kingdom who are not British citizens”.
This would have the effect of transferring responsibility for those matters to the Scottish Parliament. There is more information in the attached briefing.
