Under age discrimination legislation (Employment Equality Age Regulations) which came into force in 2006 compulsory retirement ages were unlawful unless they could be objectively justified.

However, this was subject to a national “default retirement age” (DRA) of 65 which allowed mandatory retirement for those over that age (or the employer’s normal retirement age) as long as employees were given the opportunity to exercise their right to request working beyond retirement age.
