    The Bill is a Private Members Bill. It was introduced in the House of Lords by Lord Lloyd of Berwick, a former Law Lord. The Bill had all party support and completed all its stages in the House of Lords. It is expected to have its Second Reading in the House of Commons on 12 June 2009. It deals with Parts 2-4 of the Bill, which include provisions for a new right for disabled people to control how public resources are used to meet their needs, new powers to enforce child maintenance, and for the joint registration of births.     Mental Capacity Bill (Bill 120 of 2003/04)

    The Mental Capacity Bill became the Mental Capacity Act 2005, which came into force during 2007. As amended, it provides a legal framework and statutory code of practice for decision-making on behalf of those who lack capacity to make decisions for themselves, creates a statutory basis for advance directives to refuse treatment (“living wills”), and provides safeguards relating to deprivation of liberty. The Act also established a new Court of Protection and the Office of the Public Guardian.
