    Carer’s Allowance

    This Commons Library briefing looks at Carer's Allowance - a non-contributory, non-means-tested benefit paid to people who care full-time for someone who is severely disabled. It covers the background to the benefit and issues frequently raised by people claiming it, including the level of the benefit, its interaction with other benefits including the Retirement Pension, and the difficulties recipients face when seeking to combine their caring duties with paid work or studying. Reforms to Carer's Allowance have been discussed, but there have been no significant changes to the benefit in recent years, and Carer's Allowance will remain a separate benefit under the Universal Credit system. Responsibility for Carer's Allowance and related disability benefits is now devolved to the Scottish Parliament. The Scottish Government has introduced a Carer's Allowance Supplement, and Carer's Allowance in Scotland will be replaced by a new benefit - Carer's Assistance - starting from winter 2021.

    ESA and PIP reassessments

    This Commons Library briefing paper looks at the rules on reassessing Employment and Support Allowance, Universal Credit and Personal Independence Payment claimants. Starting from 29 September 2017, some ESA and UC claimants with the most severe conditions will not have to face reassessment. PIP claimants receiving the highest level of support and whose needs are unlikely to improve may only have a "light touch" review every ten years. The Government also intends to exempt from reassessment PIP claimants over State Pension age, unless they report a change in their needs, from late spring 2019.

    This House of Commons Library briefing explains what Deprivation of Liberty Safeguards (DoLS) are, their purpose and the process which is followed in order to authorise a deprivation of liberty. The paper outlines the Law Commission's recommendations to abolish DoLS and replace them with a new system called the Liberty Protection Safeguards. The Mental Capacity (Amendment) Bill was introduced to the House of Lords on 3 July 2018. The Bill broadly follows the Law Commission’s recommendations, with some changes.
